Now the court has ruled: The Regional Court of Berlin II (Landgericht Berlin II) has dismissed the lawsuit against Fastic in full. Fastic has thus won the proceedings in the first instance. The court confirmed that, in the reviewed ordering process, users were transparently informed about the price. The costs of the legal dispute must be borne by the Federation of German Consumer Organisations. The decision is not yet legally binding.

What did the court decide regarding the consumer association's lawsuit against Fastic?
At the heart of the proceedings was the ordering process for a Fastic prevention course. Among other things, the Federation of German Consumer Organisations criticised how Fastic informs users about the cost of the course and the possible reimbursement by statutory health insurers.
The court examined the ordering process as a whole and reached a clear conclusion: users were transparently informed about the price. The possible reimbursement by health insurers was also clearly recognisable within the ordering process.
In the court's view, it was clear to users that the prevention course must first be paid for. Afterwards, the costs can be partially or fully reimbursed – depending on the respective health insurer.
Before ordering, users could also see what the course costs and what reimbursement is provided for their selected health insurer.
The court therefore dismissed the consumer association's lawsuit against Fastic on all counts.
How the Fastic prevention course works
Through Fastic, you can book a certified online prevention course in accordance with Section 20 of the German Social Code, Book V (§ 20 SGB V).
The course is paid for first. Many statutory health insurers then reimburse part of the course costs – depending on the insurer and plan, reimbursement can be up to 100 percent.
How high the reimbursement actually is depends on your health insurer and its respective requirements.
